*IMPORTANT ADDITIONAL INFORMATION REGARDING YOUR BOOKING

You must not accept any booking unless you understand and agree with the following terms and conditions.

Airline Doctors, Inc and the division providing travel services is referred to as “Alaska Travel Desk” or “Alaska & Yukon Tours”.  References to “Tour Operator” herein refer to Alaska Travel Desk.

Acceptance of Risk:  By traveling with the Tour Operator you acknowledge that you have considered any and all potential risks to your health and/or safety. You hereby assume responsibility for all such risks and release the Tour Operator from all claims and causes of action arising from any losses, damages or injuries or death resulting from risks inherent in travel, including adventure travel including but not limited to, visiting foreign or domestic destinations, and participating in adventurous/outdoor activities such as those included, but not limited to, in Tour itineraries or otherwise offered by the Tour Operator.

You acknowledge that the degree and nature of personal risk involved depends on the products or services booked and the location(s) in which a product or service operates, and that there may be a significant degree of personal risk involved in participating, particularly participating in physical activities, travel to remote locations, carriage by watercraft or aircraft, participation in outdoor activities, or other high-risk activities, or travel to countries with developing infrastructure or to rural parts of the United States & Canada. Standards of hygiene, accommodation and transport in certain countries or parts of rural America & Canada where Tours take place may be lower than the standards you may reasonably expect in your home country or region. You agree that the Tour Operator is not responsible for providing information or guidance with respect to local customs, weather conditions, specific safety concerns, physical challenges or laws in effect in any locations where a Tour, product or service is operated. You acknowledge you have considered the potential risks, dangers and challenges and your own personal capabilities and needs, and you expressly assume the risks associated with travel under such conditions.

Booking Process/Procedures: Prospect participants shall use the Online Booking Tool (OBT) on AYT’s website or contact AYT directly to begin the initial quote stage.  Packages are based on airfare from specific points, and subject to availability; along with hotel pricing dependent on occupancy; transfers between airport/destination inside Alaska & the Yukon; and a specific number of days for excursions and/or activities.  Activities and excursions are by request at time of booking, and shall be confirmed with the traveler not more than 7 days prior to departure.   Participant shall agree to provide full, complete and accurate information in your booking.  AYT assumes no liability for failure of the booking party to provide full, complete and accurate information 

Travel Agent: Airline Doctors, Inc dba Alaska & Yukon Tours and its affiliated entities acts as a travel agent only. We sell various travel related products on behalf of numerous transport service providers and accommodation service providers, including, but not limited to airlines, coach, rail, cruise line operators, wholesalers, tour operators, and hotels. AYT does not own, operate, manage or control these independent suppliers of services and is not liable for their acts or omissions. AYT’s obligations to you are to make travel bookings on your behalf and to arrange relevant contracts between you and the travel service providers. We have no responsibility for these services, nor do we have the authority to make any warranty or representation regarding their standard. A request cannot be guaranteed. All bookings are subject to the terms and conditions and limitations of liability imposed by these travel service providers. You understand that your legal recourse is against the specific provider not AYT.

Important Conditions: Prices are subject to increase prior to the time you make full payment. Prices are not subject to increase after you make full payment, except for charges resulting from increases in government-imposed taxes or fees. As noted above, by making the booking, you expressly acknowledge your acceptance of these conditions (i.e. increases before full payment and increases attributable to government-imposed taxes, fees or carrier imposed surcharges after full payment will be your responsibility) applicable to your purchase.

Cancellation: Please be aware that many travel bookings are non-refundable and cancelled bookings will incur charges. These charges can be up to 100% of the cost of the booking, regardless of whether travel has commenced. Where we incur any liability for a cancellation fee or charge for any booking which you cancel, you agree to indemnify us for the amount of that fee or charge.  Cancellation policies shall be outlined on the confirmation email sent by AYT.

Payments: You may be required to make a deposit and such deposits are non-refundable. Final payment is required no less than 90 days prior to departure unless otherwise stated for most cruise & tour packages. Some airfare or services must be paid in full at the time of booking confirmation. AYT accepts cash, debit card or credit cards (AMEX, Visa, MasterCard, Discover or Diners), bank transfer, Zelle, and PayPal. Should you wish us to charge your credit card we may require you to read and sign a credit card charge form along with a copy of government issued photo id.  When using bank transfer, Zelle, and/or PayPal, AYT requires the funds be available and cleared within 24 hours prior to final payment date.

Credit/Debit Card Transactions: If for any reason, any travel service provider is unable to provide the services for which you have contracted, your remedy lies against the provider, and not against AYT and in the event that payment has been made to AYT by credit card, you agree that you will not seek to charge back your payment to AYT. If AYT incurs any costs, including but not limited to attorneys’ fees, to recover any payments charged back by your credit card company, you agree that you will be liable for these costs. If the credit card is declined, you guarantee that you will settle any amounts owing to AYT via bank transfer, PayPal, money order or cash immediately.

Travel Insurance: For your protection, we strongly recommend that you purchase trip cancellation and travel accident insurance. However, no representation or description of the insurance made by AYT to you, constitutes a binding assurance or promise about the insurance. Please complete your travel insurance form, sign it and return it to us. If you decline travel insurance you will be required to accept a disclaimer. AYT is not an insurance company and has no responsibility for the submission, payment or adjustment of any insurance claims. Any claims that may fall under the relevant travel insurance policy must be submitted to the insurance company identified in the policy.

Additional Fees: Additional taxes and surcharges (including carrier imposed surcharges) that cannot be pre-collected may be charged locally by car rental agencies, hotels or other suppliers.  There may be instances in which an airport or foreign government may impose additional taxes and/or surcharges that are required to be paid at check-in.

Baggage Fees: Additional fees for baggage may apply. Please contact your airline or refer to its website for detailed information regarding their checked baggage policies.   AYT may not always be aware of exemptions due to fare class & status, but we will provide you with the most current information at time of booking.

Responsibility: We always do our best to make sure your travel arrangements are satisfactory. However, AYT and its affiliates and their employees, shareholders, subsidiaries, officers, directors, agents, outside contractors, and assigns do not own or operate any entity which provides goods and services for your travel including without limitation, lodging facilities, airline, vessel, motor coach, or other transportation companies, guides or guide services, local ground operators, providers or organizers of optional excursions, food service providers, etc. All such persons and entities are independent contractors and are in no way affiliated to AYT or any of AYT’s affiliated entities.

Liability: Alaska & Yukon Tours and its parents, subsidiaries and their respective employees, affiliates, officers, directors, successors, representatives, and assigns shall not be held liable for (A) any damage to, or loss of, property or injury to, or death of, persons occasioned directly or indirectly by an act or omission of any other provider, including but not limited to any defect in any aircraft, watercraft, or vehicle operated or provided by such other provider; and (B) any loss or damage due to delay, cancellation, or disruption in any manner caused by the laws, regulations, acts or failures to act, demands, orders, or interpositions of any government or any subdivision or agent thereof, or by acts of God, strikes, fire, flood, war, rebellion, terrorism, insurrection, sickness, quarantine, epidemics, theft, or any other cause(s) beyond their control. You waive any claim against Airline Doctors, Inc or AYT for any such loss, damage, injury, or death.

Notwithstanding anything to the contrary elsewhere in these Terms, AYT will not in any circumstances be liable to you for any loss or anticipated loss of profit, loss of enjoyment, loss of revenue, loss of use, loss of contract or other opportunity nor for any other consequential or indirect loss or damage of a similar nature.

Fit to Travel: AYT reserves the right to request further information or professional medical opinions where necessary, as determined in its discretion, for your safety or the safe operation of a Tour or package.  AYT shall attempt to provide Tours & activities that suit some medical limitations (including mobility & sensory challenges).

AYT reserves the right to deny you permission to travel or participate in any aspect of a Tour at any time and at your own risk and expense where the AYT determines that your physical or mental condition renders you unfit for travel or you represent a danger to yourself or others.

Pregnancy is considered a medical condition and must be disclosed to AYT at the time of booking. AYT may refuse to carry women who are over 24 weeks pregnant. AYT may refuse to carry anyone with certain medical conditions if reasonable accommodation or alternatives cannot be arranged.

Passports: All individuals departing from the United States of America and/or Canada must be in possession of a valid passport. It is your responsibility to ensure that you have valid travel documentation, including but not limited to passports and visas, which meet the requirements of immigration and other government authorities at every destination. You are responsible for confirming with the United States Department of State or representative government agency of the country to which you are traveling to confirm the requirements for visas and/or other requirements for admission to your destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be your sole responsibility. A government issued ID is required for travel within the USA.

Travel Documents: Travel documents including, without limitation, airline tickets, hotel vouchers, tour vouchers or any other document (whether in electronic form or otherwise) used to confirm an arrangement with a service provider. Travel documents may be subject to certain conditions and/or restrictions such as, but not limited to, being nonrefundable, non-date-changeable, and subject to cancellation and/or amendment fees. Travel documents cannot be transferred to another person to use. All airline tickets must be issued in the name of the passport/photo identity holder. An incorrect name on a booking may result in an inability to use that booking and the booking being cancelled. Any errors in names, dates and timings may result in an inability to use that booking and the booking being cancelled. Any errors in names, dates and timings on your documentation will be your responsibility if not advised at the time of booking.

Health and Special Requirements: It is your responsibility to ensure you are aware of any health requirements for your travel destinations and to ensure that you carry all necessary vaccination documentation. You MUST advise your travel consultant & AYT of any special requirements you may have, for example, special meals, medical requirements and so on.  Mobility limits and requests should be done at time of confirmation with travel consultant.

Force Majure: AYT will not be liable in any way for death, bodily injury, illness, damage, delay or other loss or detriment to person or property, or financial costs both direct and indirect incurred, or for AYT’s failure to commence, perform or complete any duty owed to you if such death, delay, bodily injury (including emotional distress or injury), illness, damage or other loss or detriment to person or property is caused by Act of God, war or war like operations, mechanical breakdowns, terrorist activities or threat thereof, civil commotions, labor difficulties, interference by authorities, political disturbance, howsoever and where so ever any of the same may arise or be caused, riot, insurrection and government restraint, fire, extreme weather or any other cause whatsoever beyond the reasonable control of AYT; or an event which the AYT or the Third Party Supplier of services, even with all due care, could not foresee any and all of which, individually and collectively, constitute “Force Majeure”.

International Flights: Some countries require insecticide spraying of aircraft prior to a flight or while you are on the aircraft. Please see the Department of Transport disinsection website for more information.

Refusal of Service: Service providers reserve the right to refuse service to travelers at their sole discretion and including without limitation if the traveler:

  • Lacks proper documentation for the country of destination;
  • Has a contagious disease;
  • Is under the influence of alcohol, drugs or narcotics; and/or
  • Manifests disruptive and/or unruly behavior.

AYT assumes no liability for the acts of the service provider in refusing service.
